- The contract between us
We must receive payment of the whole of the price for the goods that you order before your order can be accepted. If you are paying on finance, you need to have been accepted for finance, paid your deposit and signed the finance agreement. Payment of the price represents an offer on your part to purchase the goods, which will be accepted by us only when the goods are dispatched. Only at this point is a legally binding contract created between us.
- Acknowledgement of your order
During checkout you will be asked for your e-mail address and delivery address details. Once checkout is complete and payment is processed, we will send you a confirmation of order along with invoice. Please note this may be the next day if you placed your order in the evening. This correspondence does not constitute a contract between us.
- Ownership of rights
All rights, including copyright, in this website are owned by or licensed to DreamBedMakers. Any use of this website or its contents, including copying or storing it in whole or part, for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose. DreamBedMakers own all materials/information contained on this website. You are granted limited license only for purposes of viewing/ordering the material.
- Accuracy of content
We have taken care to ensure prices quoted are correct at time of publishing and goods are described accurately. Orders will only be processed if there are no material errors in the description of the goods or their prices. Any weights, dimensions and capacities given are approximate only.
- Damage to your computer
We try to ensure this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable for any loss or damage which may arise to computer equipment as a result of using this website.
- Availability
All orders are subject to acceptance and availability. If the goods are not available the item will show as out of stock or you will be notified by our customer service team with a lead time. You will have the option to wait, accept an alternative, or cancel your order.
If we are unable to supply the product and payment has already been made, your account will be refunded or re-credited with the sum paid. The refund will be carried out as soon as possible, in any event within 30 days of the order. We will not be obliged to offer compensation for disappointment suffered.
- Ordering errors
You can correct errors on your order up to the point you click “submit” during the ordering process. You will be liable if an error is made and you do not make us aware 24 hours prior to the agreed delivery date. If goods have already been dispatched, your refund will be subject to a return fee which will automatically be deducted.
- Price
The prices payable for goods are as set out on our website. All prices are inclusive of VAT at the current rates and are correct at time of entering information.
- Payment terms
Browse our website, add items to the shopping cart, and click ‘Checkout’ to complete your order.
We accept credit card payments through Stripe online payments: Visa, Mastercard, Maestro, Visa Electron.
All items are charged to your card immediately after your order is placed. If your item is on a longer lead time you will be notified by email.
We will then dispatch the item with the courier who will contact you to arrange delivery with a timeslot.
Please do not e-mail credit card information. We cannot take payments over the telephone for security purposes.
- Delivery charges
We deliver free of charge within England, Wales & Scotland excluding postcodes listed in our delivery terms.
If you are in the Scottish Highlands or a listed postcode, our couriers charge a nominal fee. These charges are normally added at checkout after you enter your postcode. If not present but listed as excluded, we will call after order to get permission to take the charge from your card.
- Delivery
11.1 Our delivery charges are set out under our shipping policy.
11.2 We only deliver to addresses within the UK excluding Northern Ireland. We cannot deliver to Ireland.
11.3 We will deliver to the address you specify. If you have delivery instructions, email info@dreambedmakers.co.uk. We cannot accept liability for loss or damage once delivered in accordance with your instructions unless caused by our negligence. Failed delivery due to unanswered calls will incur a minimum £40 redelivery charge.
11.4 We aim to deliver by the date quoted on each product page but times are not guaranteed. If delayed, we will contact you with revised time so you can continue or cancel. We are not liable for direct, indirect or consequential loss caused by delay.
11.5 Multiple items will be delivered together once all are available.
11.6 You become the owner when goods are delivered. Once delivered they are held at your own risk.
11.7 Failed delivery/collection or changes within 48hrs of confirmed date incur a minimum £40 charge.
11.8 If drivers cannot get item upstairs due to fit or safety, you may accept delivery, make own arrangements, or reject delivery. Rejection incurs a £60 minimum charge.
11.9 DreamBedMakers and contractors accept no liability for damage to delivered product or customer property while assisting delivery to room of choice. Customer takes full responsibility.
11.10 All upgraded delivery charges must be paid in full prior to delivery and are non-refundable once dispatched.
11.11 Contracted deliveries will not set up your item. Most beds are flat pack and require assembly.
11.12 Delivery timeslots are a guideline only. We will not compensate for deliveries outside allocated timeslot. Courier may call 30-60 mins before arrival.
11.13 Drivers cannot remove shoes for health and safety. Please protect flooring prior to delivery.
11.14 We do not accept blame for customers disposing of old beds/mattresses before delivery. Dispose only after acceptance of new goods.
11.15 Once dispatched there is a minimum £60 cancellation fee. If item is not on our website we cannot accept it back.
11.16 Couriers deliver to ground floor or 1st/2nd floor room of choice. No delivery above 2nd floor without lift.
11.17 Products may be delivered in advance of quoted date if communicated to buyer.
11.18 National carrier deliveries are by one man to your front door.
11.19 All goods must be signed for. We cannot deliver to unattended premises.
11.20 DreamBedMakers only deliver to doorstep or just inside front door. Flats: ground floor only.
11.21 If we agree to room-of-choice, no extra charge. Passageways/rooms must be cleared.
11.22 Contractors will not assemble orders. Assembly is customer responsibility. Use protective sheets as goods may have transferred through warehouses. We accept no liability for damage caused.
11.23 Before signing, check boxes for damage.
- Risk and ownership
Risk of damage or loss passes to you at time of delivery. You only own goods once delivered. As per 11.9 we accept no liability for damage to product or property during delivery assistance.
5 Year Warranty
13.1 All DreamBedMakers bed frames, mattresses, and ottoman storage beds come with a 5 year structural warranty from the date of order. This covers defects in frame, workmanship, and materials under normal domestic use. This is in addition to your statutory rights.
13.2 We shall not be liable under the warranty if:
13.2.1 The defect arises due to damage, misuse, negligence, wilful damage, abnormal working conditions, or failure to follow assembly/care instructions;
13.2.2 The product shows wear and tear, stains, marks, or damage caused by the buyer;
13.2.3 The buyer alters or repairs the product without our written consent; or
13.2.4 The buyer has not paid the full contract price.
13.3 If valid, we will repair or replace the defective part/product free of charge within 30 days of examination.
60 Night Risk-Free Trial
14.1 We offer a 60 night risk-free trial on all products including bed frames, mattresses, and ottoman storage beds, starting from the date of delivery. If you’re not 100% happy, you can return it for a refund.
14.2 The trial is void if the product is damaged, stained, marked, assembled incorrectly, or shows any wear and tear caused by the buyer. The item must be in original, resalable condition with all packaging. For ottoman storage beds, mechanisms must be unused and undamaged.
14.3 Return fee: If you choose to return under the 60 night trial, a £99.99 collection and processing fee will be deducted from your refund. This covers courier collection, inspection, and repackaging.
14.4 To initiate a return, email info@dreambedmakers.co.uk with your order number. We will arrange collection. Refunds are processed within 14 calendar days of receiving the item back in acceptable condition.
Cancellation rights
15.1 Under The Consumer Contracts Regulations 2013 you can cancel up to 14 calendar days after receiving goods. No charge before dispatch.
Once dispatched with courier (usually 6-10 days before delivery) or delivered, minimum £60 charge to cancel or return your order, unless returning under the 60 Night Risk-Free Trial which is subject to clause 14.3.
Your rights are protected under the EU Distance Selling Directive.
15.2 To cancel, email info@dreambedmakers.co.uk with name, order number and clear statement of cancellation. If received, email to arrange return.
15.3 If received before cancelling, retain possession and take good care until collected.
15.4 Once you notify us, and we receive goods back or evidence of return, we will refund within 14 calendar days.
15.5 We may deduct for loss in value if goods not adequately packaged. Goods must be returned in original packaging. Mattresses cannot be slept on and bed frames cannot be part/fully assembled if cancelling, unless under 60 Night Risk-Free Trial and in original resalable condition per clause 14.2.
Cancellation by us
16.1 We may not process your order if:
16.1.1 Insufficient stock;
16.1.2 We do not deliver to your area; or
16.1.3 Item listed at incorrect price due to error.
16.2 If we do not process, we will notify by email and re-credit your account within 14 days.
If there is a problem with the goods
17.1 For faulty items contact us within 7 days at info@dreambedmakers.co.uk with details and photos.
17.2 We must supply goods that conform with the Consumer Rights Act 2015.
17.3 To reject non-conforming goods you must allow us to collect them. We pay collection cost.
Liability
18.1 If goods not received within lead time and you cancel, we provide full refund. If already dispatched, minimum £60 charge applies unless under 60 Night Risk-Free Trial per clause 14.3.
18.2 We are only responsible for foreseeable losses from breach of these terms. No liability if prevented by your actions or events beyond reasonable control.
18.3 No liability for business losses: lost data, profits, revenues, or interruption.
18.4 You must comply with all regulations including customs/import permits. We make no representation and accept no liability for export/import.
18.5 Nothing limits your statutory rights or excludes our liability for death/personal injury from negligence.
Notices
Unless otherwise stated, all notices must be in writing to our contact address.
Changes to legal notices
We reserve the right to change these terms and conditions. Please review regularly.
Law, jurisdiction and language
This website and any contract are governed by English law. Parties submit to exclusive jurisdiction of courts of England and Wales. All contracts concluded in English.
Invalidity
If any part is unenforceable, the rest remains in effect.
Privacy
You agree to be bound by our privacy policy.
Third party rights
Nothing in this Agreement confers rights on a third party.
